HERSHEY'S EASTER: Coloring Contest

HERSHEY'S "COLORS OF SPRING" COLORING CONTEST OFFICIAL RULES

ELIGIBILITY: NO PURCHASE NECESSARY. HERSHEY'S "COLORS OF SPRING" COLORING CONTEST ("Contest") is open to legal U.S. residents between the ages of 4 and 12 at the time of entry. Void in Puerto Rico and where prohibited or restricted by law. Employees of The Hershey Company and its affiliates, advertising and promotion agencies, printers and judges, and their immediate families and individuals residing in the same household with any of these employees, are ineligible to enter or win.

HOW TO ENTER: Contest will be divided into three age brackets: ages 4-6, ages 7-9 and ages 10-12. Go to www.keepeastereasy.com and printout the Coloring Page/Entry Form posted for participant's age. Mail colored and completed Coloring Page/Entry Form to: Hershey's Colors of Spring Coloring Contest, P.O. Box 8679, Woodcliff Lake, NJ 07677-8679. Limit one entry per participant, but more than one participant per household will be permitted to enter. Entries must be postmarked between February 17, 2009 and April 11, 2009, and be received by April 24, 2009 to be eligible to enter and win. Any hand drawn medium may be used to color the picture (crayons, markers, paints, etc.). Participants must use specified Coloring Page/Entry Form for their age bracket and have parental signature acknowledging permission to participate or entry may be disqualified. No responsibility is assumed by The Hershey Company ("Sponsor") for lost, late, illegible, incomplete, stolen, postage due or misdirected entries or mail.

CONTEST JUDGING: Judging for finalists and prize winners will be based on neatness (50%), use of color (30%) and originality (20%). Finalists and prize winners will be picked by a panel of judges selected by The Hershey Company, under the supervision of an independent judging organization whose decisions will be final and binding on all matters relating to this contest. In the event of a tie, additional tie-breaker judges will be appointed to determine the winners. All entry materials become the exclusive property of the The Hershey Company and will not be returned. By entering, participant and parent or legal guardian of participant represent that the artwork submitted is participant's original art. Five (5) Finalists will be selected from each age bracket on a weekly basis beginning Monday, March 2, 2009. The final weekly judging will be Monday, April 27, 2009. All Finalists' artwork will be posted online at www.keepeastereasy.com along with their first name, last initial and age. Prize winners will be selected from all finalist entries on or about May 1, 2009. Potential prize winners will be notified by May 20, 2009 by mail. If mailed prize notification is returned as undeliverable for any reason, prize winner may be disqualified and the finalist with the next highest score will be selected as the alternate winner.

PRIZES: One (1) First Prize, one (1) Second Prize and one (1) Third Prize in each age bracket will be awarded. First prize is a U.S. Savings Bond in the amount of $1000. Approximate retail value ("ARV") of each first prize: $500. Second prize is a $100 Hershey Gift Basket. ARV of each second prize: $100. Third prize is a $50 Hershey Gift Basket. ARV of each third prize: $50. Total ARV of all prizes is $1950. Prizes are not transferable. Sponsor reserves the right to substitute a prize of equal or greater value if any prize becomes unavailable for any reason. Prizes cannot be redeemed for cash or substituted. Limit one prize per person. All prizes will be awarded, provided that a sufficient number of entries are received. Allow 6 weeks for delivery of prizes. All federal, state and local taxes are the sole responsibility of the prize winner. Each of the potential first prize winners must sign and return an Affidavit of Eligibility and Originality, a Release of Liability/Publicity and a Prize Acceptance Form within 7 days of receiving notification as a condition of receiving the prize (except to the extent any of these are prohibited by law). Parent or legal guardian of potential first prize winners will be required to sign the affidavits, releases and acceptance form and the prize will be awarded to the parent or legal guardian.

WAIVER: By entering, participant waives all rights to claim punitive, incidental and consequential damages, attorneys' fees or any damages other than actual out-of-pocket costs or losses that may arise in connection with participation in the Contest or acceptance, possession and use of any prize. By accepting any prize, winner agrees to the use of his/her name, address, artwork, likeness, photograph and/or voice and statements by winner for advertising/publicity purposes without notice or further compensation, unless prohibited by law. By entering, participants agree that this Contest is governed by laws of the Commonwealth of Pennsylvania, without regard to conflicts of laws principals, and all participants hereby submit to the jurisdiction and venue the state and federal courts in the Middle District of Hershey, Pennsylvania for the resolution of all claims and disputes.
